Brandenburg v. Ohio

Brandenburg v. Ohio, 395 U.S. 444 (1969)* is an American court case based on the 1st Amendment to the US constitution. It was argued before the Supreme Court on February 27, 1969 and decided June 9, 1969

Brandenburg was a Ku Klux Klan leader convicted of advocating violence under Ohio's Criminal Syndicalism law. The court overturned his conviction on the grounds of the statute violating the 1st and the 14th amendments.
