Ex Parte Merriman

Ex Parte Merriman is an important U.S. Supreme Court case from 1861.

Here the court ruled, against President Lincoln’s wishes, that the writ of habeas corpus may not be suspended, even in wartime or other extreme emergency. The case arose out of the Civil War conflict.
